“Yes” combines “Yes always” and “Yes, sometimes, depending on the circumstances.” For Democrats, the number is higher than other polls, which usually just ask “Yes” or “No.” Those polls have shown Democrats in the 35%-50% range for “Yes,” which would not be enough to qualify as agreement under the Americans Agree rules.
Policy Context
When this poll was conducted in November 2025, there had not been any major news about the death penalty. Earlier in the year, on President Trump’s first day back in office, he signed an executive order that directed the Justice Department to aggressively resume and expand the use of federal capital punishment and to push states to do the same.
